Terms of Service

These Terms govern access to Tiply and the digital tipping services offered through it. By using the service you agree to these Terms.
1. The provider
Tiply (the operator of tiplyofficial.app) provides the platform described in these Terms. Contact: hello@tiplyofficial.app. Registered company details are provided on request to counterparties who require them for contracting.
2. Acceptance of these Terms
By creating an account, connecting a Stripe account, or leaving a tip through a Tiply page, users accept these Terms. Users who do not accept them must not use the service.
3. Description of the service
Tiply enables guests and customers to send digital gratuities ("tips") to hospitality and service professionals. Payments are processed by Stripe under Stripe's own terms; Tiply is not a bank, payment institution or e-money issuer, and does not hold funds on behalf of professionals.
4. Eligibility and accounts
Professional and business accounts are available to individuals aged 18 or older who are able to lawfully receive payments in their country of residence. Account holders are responsible for the accuracy of the information they provide and for the security of their credentials.
5. Tips
Tips are voluntary payments from the guest to the professional. Once a tip is completed it is generally non-refundable, except where required by applicable law or where a refund is initiated by the professional or by Stripe.
6. Fees
Tiply charges a platform fee on each successful tip, disclosed at the time of payment on the tipping page. Stripe processing fees are shown separately. The professional or business receives the net amount after both fees.
7. Payouts
Payouts are routed directly by Stripe to the connected account of the professional or business. Payout timing, minimums, currency conversion and reserve policies are governed by Stripe.
8. Taxes
Professionals and businesses are solely responsible for declaring and remitting any taxes or social contributions due on tips received through Tiply. Tiply does not provide tax advice.
9. Acceptable use
Users must not:
- Use Tiply for any illegal purpose or to launder funds.
- Impersonate another professional or business.
- Attempt to bypass rate limits, authentication or payment safeguards.
- Upload content that is unlawful, defamatory, or infringes third-party rights.
10. Suspension and termination
Tiply may suspend or terminate an account that violates these Terms, is used fraudulently, or that Stripe requires to be disabled. Users may close their account at any time from the dashboard.
11. Liability
To the fullest extent permitted by applicable law, Tiply's aggregate liability arising out of or in connection with the service is limited to the platform fees actually received by Tiply from the affected account in the twelve (12) months preceding the event giving rise to the claim. Nothing in these Terms excludes liability that cannot be excluded by law, including for gross negligence or wilful misconduct.
12. Governing law and jurisdiction
These Terms are governed by the laws of Spain. The competent courts of Barcelona have exclusive jurisdiction, subject to any mandatory consumer protection rights available to a user in their country of residence.
13. Changes to these Terms
Tiply may update these Terms from time to time. The updated version is effective on publication; continued use of the service constitutes acceptance.
